These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you (whether individually or on behalf of an enterprise entity, "User" or "You") and PhotoEditorAI.in ("Company", "We", "Our", or "Us"), headquartered in Bengaluru, Karnataka, India.

By accessing our web studio, initiating automated API calls, or purchasing credit packs, you confirm that you are at least 18 years of age (or have reached the age of majority in your jurisdiction) and possess full legal capacity to enter into this contract. If you disagree with any provision of these Terms, you must discontinue use immediately.

PhotoEditorAI provides an intelligent digital darkroom platform utilizing cutting-edge neural vision algorithms and multimodal generative models. Our features include, without limitation:

• AI Background Remover: Alpha matting and background replacement.
• AI Photo Restoration: Scratched print repair, vintage colorization, and crease recovery.
• AI Headshot Generator: Studio portrait generation with lighting control.
• AI Photo Enhancer: 4× super-resolution upscaling and edge sharpening.
• Passport Photo AI: Automated compliance cropping for Indian passport, OCI, and global visa standards.
• Gemini Natural Language Prompting: Semantic photo transformation through conversational instructions.

You acknowledge that AI models generate outputs probabilistically based on the source quality of uploaded assets. We continually optimize models to maintain high optical fidelity.

Subject to your compliance with these Terms, you are granted a perpetual, worldwide, irrevocable, royalty-free license to use, reproduce, modify, display, publish, distribute, and commercially exploit all processed output files. You may use them for:

• E-commerce product catalog listings (Amazon, Flipkart, Shopify, Myntra, Meesho, Etsy).
• Commercial advertising campaigns across print, television, billboard, and digital channels.
• Client photography albums, wedding galleries, and studio portraits.
• Official government and institutional applications (passports, visas, student IDs).

You represent and warrant that you hold all necessary rights, permissions, and consents to upload and edit the images submitted to our pipeline.

We strictly prohibit any unlawful, fraudulent, or harmful utilization of our computational systems. You agree never to submit, generate, or solicit the following:

Violation of these safety terms will result in immediate permanent account termination, forfeiture of remaining credits, and potential civil or criminal referral under the Indian Penal Code and Information Technology Act.

PhotoEditorAI operates strictly on a transparent pay-as-you-go credit architecture:

• Non-Expiring Balance: Credits purchased have no expiration timeline and remain active for the life of your account.
• Currency & Taxes: All standard pricing is billed in Indian Rupees (INR ₹) inclusive of or detailing applicable 18% Goods & Services Tax (GST).
• Payment Gateways: Payments are securely processed via RBI-authorized partners (Razorpay), supporting UPI (Google Pay, PhonePe, Paytm, BHIM), NetBanking, RuPay, Visa, and Mastercard.
• Automated Credit Replenishment: If a technical generation fails due to a network glitch or model failure, consumed credits are automatically restored to your balance.

The services and all outputs are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, either express or implied. While we maintain a 99.98% cluster availability goal, we do not warrant that the service will be entirely uninterrupted, error-free, or that AI edits will meet subjective artistic expectations for extremely degraded or low-resolution analog originals.

To the maximum extent permitted by applicable Indian law, in no event shall PhotoEditorAI, its directors, employees, or partners be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, goodwill, or business interruption.

Our total aggregate liability for any claims arising out of or related to these Terms shall not exceed the total amount paid by you to PhotoEditorAI in the three (3) months preceding the incident.

These Terms shall be governed by and construed in accordance with the substantive laws of the Republic of India, including the Information Technology Act, 2000 and the Consumer Protection (E-Commerce) Rules, 2020.

Any dispute, controversy, or claim arising out of this Agreement shall be subject to the exclusive jurisdiction of the competent civil courts located in Bengaluru, Karnataka, India. Parties agree to first attempt informal resolution by contacting our legal desk for a minimum period of 30 days.
